It is a great honor of mine to be honoring a number of people

from my community in district two.

The few guys are here.

I know I saw you coming in. -- if you guys are here.

Everyone, together, these three individuals were the driving

force behind the recent seven-

year $21 million renovation of one of san francisco' s most beloved landmarks, the palace of fine arts.

The maybeck foundation, led by the Chairman Of the board and

campaign chair and executive director, drove the efforts to

raise more than $16 million in

private donations from over 1200 individuals.

In coordination with the maybeck

foundation, a talented team of city managers from the rec and

park department and dpw help

carry out the renovations of the

historic remnants of the 1915 pan expo. I was proud to be President At the it -- present at the official opening, and every time I walk on the palace of fine

arts ground with my children, it amazes me the work that was accomplished there.

it was a public/private partnership between san francisco and the nonprofit

maybeck foundation and funded by a combination of city and state

funds and donations from over 1200 donors. It included seismic upgrades, addition of new entryways and pathways, the replacement of the

rotunda floor and roof of the dome, stabilization of the

lagoon, and new landscaping. Today, the 95-year-old landmark is the only original structure left from the 1950 world' s fair -- 1915 world' s fair. The maybeck foundation achieved an outstanding record of success

by finishing four phases of the project in a timely manner.

this partnership is a model I can only hope we can use to move forward here in san francisco.

Personally, as you all know, I grew up a block away of the -- from the palace of fine arts and still go there with my children.

It is such an important part of san francisco history, and it is because of the great leadership of these three individuals that we are here today and the palace is where it is. First of all, I would like to

thank the executive director of the maybeck foundation who worked tirelessly to make this public/private partnership a success. She has long been involved in

these partnerships with consortium' s through executive rolls through the museum of

california and the los angeles zoo and also currently serves as the President Of the board of the california historical society. She took me on a tour of the palace along with my family right before the opening and clearly was the person on the

ground that everybody turned to to coordinate this project, so,

jan, thank you for your leadership and coordination of the project.

The Chairman Of the maybeck foundation whose m

leadership was paramount. The maybeck foundation was

established to celebrate the

legacy of bernard maybeck, who was the architect of, most importantly, the palace of fine arts.

Hans is a graduate of the yale school of architecture but most importantly a san francisco native.

He contributed not only his time on the steering committee but

also led his expertise -- his architectural expertise to the project. Thank you so much for your role.

i would also like to thank and acknowledge the new Chairman Of

the maybeck foundation, richard, who is here. I very much look forward to working together as we make certain that the work that has

been done to date at the palace of fine arts continues in this legacy.

Lastly, I want to say a special

thanks to donna huggins, the campaign chair of this project. for those of you who have not

met her or been in her presence, she is an amazing woman, beloved

by all, and truly, no amount of

praise will do justice to the banks you deserve from our city with the palace of fine arts.

She was plain and simply the linchpin of the project.

Without her, she would not -- without her, it would not have happened. You put your heart into the project. I saw it, and we all see it today.

From all of us in city hall, for all of us who hold the palace of fine arts dear, thank you so much.

Donna is also, by the way, a

collector of pieces of memorabilia from the 1915 world' s fair. In addition to these

commendations, I actually have two original pieces from the world' s fair that were originally purchased by my godparents' and given to my parents until this morning --

purchased by my godparents and given to my parents until this morning when I picked them up for you.

a book of postcards and a book of inscription detailing all the

inscriptions from the world' s fair and the meaning behind them. I look forward to giving this to you.

I did have concerns about the spontaneity of our exchanges we

have had with the mayor under this ordinance.

I still have those concerns, but

my conversation with mayor lee,

I said that I would be able to live with this.

If it is an ordinance we want to look at later on down the line, we can do that. I would like to do that at some point.

We can add a little more life into it.

I do believe that my discussions were very meaningful with the mayor, and I think we can make

this a useful tool for us and focus the mayor' s attention on things that perhaps he or

future mayor she would not be attending to. I think it would be a useful exercise to move forward on, but hopefully, we can look at building a little more spontaneity into it, and

hopefully, we will see as we move forward we will work to do that. Thanks.

supervisor wiener:   thank you. I have two items.

The mta has now begun its long- awaited collective bargaining process.

I rise today to stress the

critical importance of

bargaining to the future muni in

terms of costs and functioning of the system, as well as the

message it will send about 88' s commitment to reform.

-- about mta' s budget. We were reminded about what happens when the budget gets so off kilter for so many years that they cannot address the basics of keeping the system running.

We have a meltdown in the

subway and intel down on the market street lines.

A few weeks ago, another derailment on the subway.

We have seen a continuous stream

of malfunctions that cause people problems on a day-to-day

basis.

Muni needs to get its costs under control so it has the funding it needs to invest in its physical plans. Otherwise, we will continue to

see a deterioration of the

system, and muni needs to change the way it operates.

after the board of supervisors failed to address muni'

s labor costs and work rules, the people of san francisco took matters into their own hands.

75,000 of us signed to get

proposition g on the ballot and voted to support it.

Provides mta management with an amazing tool that will allow us to take a big step in the right direction of reforming the system.

Prop g allows mta for the first

time in decades to bargain with everything on the table.

It specifically provides mta

with the power to negotiate away

work rules that make no sense,

the cost mta millions, and that underline the functioning of the system.

Now that the voters have done

their job, it is mta' s turn to do their job and bargain effectively. It is not enough just to get a few successions and nibble around the edges.

mta must set a new base line for its employee relations and particularly for the work rules

that need to be addressed.

Mta must show fortitude to

change the way it does business.

To be clear, mta' s work rules and labor costs are not the only

reason for muni problems.

for decades, we have under invested in the system, and, of course, we are dealing with a year in europe cuts from

sacramento -- dealing with year-

in, year-out cuts from sacramento. Power to negotiate a labor agreement that is not only fair to employees but also to the

hundreds of thousands of riders,

who depend on muni

every day, mta needs to get it right.

San francisco is watching.

Finally, I have an in memoriam

to clint mitchell, a resident of district 8. To san francisco, the mission

district, and liberty hill, all

of us were diminished on March

2, when clint mitchell died at

home at the young age of 50, surrounded by his wife, his

stepson, family, and friends.

Everything about clint mitchell

was vague. He'

ll -- was a big -- was big.

He was a big man, over 6 feet tall.

His generosity was huge, whether spearheading a neighborhood project or hosting an event for death penalty focus or for friends.

He was the consummate volunteer, dedicating large amounts of time and effort to causes as diverse

as the san francisco civil grand

jury and the san francisco international wine and spirits competition. He was never one to turn down a

chance to help participate and lead.

As President Of the liberty hill neighborhood association, his leadership was essential.

He led by example, diving into any and all challenges and projects that came his way.

His intelligence and preparation shown through everything he did

heshone -- his intelligence and

preparation shone through everything he did, and he will be missed.

supervisor campos:   thank you, Madam Clerk. Colleagues, I have a number of items.

The first item is a little more -- is to provide a little more specificity about an issue that came up and that I address at the last meeting, which has to do with a historic site located in my district.

For those of you who May not be

aware, in 1991, a longtime resident of vernal heights and

covered a venture -- vintage coca-cola sign under the

asbestos siding on his home.

Hearkens back to a time of old

bernal heights.

An anonymous complaint led to

the discovery that the historic

sign was out of compliance with local laws because it had uncovered for about 35 years. When the story first broke, we

heard a number of perspectives on this issue.

Some people raise concerns about the potential health message that it would send children to

have a coca-cola sign,

especially being in front of a school. Others voiced a very strong

desire to preserve the sign as an historic treasure.

Since the story broke a few weeks ago, my office has

received a number of calls, a

number of e-mails from residents

throughout bernal heights. We have also taken the time to

check with parents at the paul revere elementary school where the sign is across the street from it.

Overwhelmingly, the response has

been supportive of preserving the sign. I am looking at the issue, we have learned how complicated and

complex it is to actually

protect a sign of this nature, how difficult it is

procedurally to establish an historic signing district.

To protect this kind of a sign,

a property owner has to request the establishment of a historic

signing district that would have

to get legislative approval that

has to be introduced here at the board of supervisors. It also has to get conditional

use authorization from the planning commission.

This project was established -- the process was established in order to protect a large number of historic signs in a given

area, but signs like the one we

are talking about exist outside many areas in san francisco. The legislation we are

introducing is legislation that

tries to simplify this process.

It is simply would simplify the

application process that you would have to follow by clearly defining what it means for a sign to the historic and by

streamlining at the planning commission the conditional use process. Our hope is that through this legislative effort that we will

be able to simplify the issue, should this matter come up again

and another district -- in another district, which we believe is likely.

I want to thank the attorney' s office for working so closely with my office to, again, simplify this process.

The second item in introducing

is a hearing request at the government audits and oversight committee on the issue of an

audit that was conducted by the

city service auditor on the use

of the laguna honda fund that was created for the use of patients, and there was an audit on that issue that was completed, and we want to have a hearing on that. The last item I am introducing

is a resolution declaring march

26, 2011, as senior officer --

monsignor officer romero day to

honor monsignor officer romero who dedicated his life and ultimately gave his life to protect human rights. He was essentially murdered at

the altar at a small

chapelhe has truly become a symbol.

For the fight for social justice and human rights.

He means a great deal to many of us in san francisco.

not only people from hong the el

salvadorean community and the

latino community, anybody that

believes in human rights and social justice.

I have a number of items.

I am sad to inform everyone of

the passing of the founder of tommy' s mexican restaurant.

He passed away last week.

he came to san francisco as part

of a guest worker program with

his wife who is a really great person as well.

He fulfilled his lifelong dream

of serving his native cuisine.

with the opening of the restaurant, he enabled countless

members of family and friends to move north to san francisco.

He greeted his customers for over 45 years.

known for its warm and friendly

atmosphere, it greatly reflected himself.

His sudden death has come to a

shock to many -- as a shock to many of us.

The small business

establishments he founded, our thoughts and prayers are with his family and friends.

The next item is an ordinance protecting local pet stores and

small businesses.

I am introducing an ordinance to

prohibit pet supply stores in an

already defined district that

extends from fourteenth avenue to 28 avenue.

This legislation was promoted by a coalition of small businesses

and many constituents and my

office and myself to protect the

several small mom-and-pop pet

supply businesses.

I believe that limiting large formula retail pet supply stores will help preserve our small

businesses.

and the mix of goods and services in the corridor.

I am pleased to work with the

folks here, and their hard work

here for the upcoming arbor day.

what I have for you today is

legislation for today oppose the imperative edge in the declaring March 12, 2011 as arbor day.

Supervisor avalos and I were

talking about Dr. Seuss' s lorax.

he is a little guy that stands on the stump and speaks for the trees.

Many of the environmentalists

and activists see lorax' s.

They protect the trees and create a livable community.

originally proposed in the late 1900' s, it was proposed as a tree planting holiday.

The first brigade was the planting of more than 1 million trees.

It has spread throughout the

united states.

Community volunteers in the city

workers will be planting trees and dust in a community cleanup in my district this year.

-- hosting a community cleanup in my district this year.

It is a way to make our community more environmentally friendly and the level.

-- livable.

later, when we hopefully pass

this item unanimously, and gloria is here to answer any questions if you have them.

The last items I am proud to be cosponsoring a resolution with

mayor lee.

it will support the use of rainy day funds for the san francisco

schools.

Given the state budget crisis, and the schools might be laying off teachers and staff in the coming months and weeks.

some are support of --

supportive in this difficult period.

And I think that' s an item

already introduced.

Campos and mirkarimi have asked to be added on.

Supervisor chu has been working

on this issue for many years.

the seismic safety project was

designed to provide the department of building

inspection information to reduce the earthquake risks.

It puts many people that live

behind garages in je apordy.

-- in jeopardy .

The report includes several recommendations that would require us to take legislative

action to reduce the risk to san

franciscans in the event of an earthquake.

Just a couple of items for introduction.

One is a resolution as part of

our better neighborhoods plan

for the parking area -- park area.

A grocery store at the site.

Currently, they have plans to hirez

non-union staff that pay

well below prevailing wages.

it encourages them to consider

union carpentry at the site that

will be going to city operations and neighborhood services committee next monday.

I also wanted to address a

concern I have about the

agreement between the mta and

bart on the fast pass reimbursement.

The board of director' s has

approved teh agree -- the

-the agreement.

It will be about 17% increase.

what will happen on a yearly basis, there is a cost-of-living

increase up to 10% that would be

alarming for the mta budget.

I would like to request perhaps the budget committee consider

not hearing it or objecting, go

back and renegotiate the contract.

It would have enormous impact on the ability to maintain a level of service.

it will ensure that [Unintelligible]

ordinances related to each other in working with the department of public works and the mayor' s

office.

These aim to increase and intensify our efforts in

cleaning up blight in san francisco.

it includes criminal and administrative penalties that would be consistent with the minimum $100 fine.

It amends the public-works code

to provide issuance for

administrative citations and for constitutional reasons is not affect political speech.

portions of the public works co ,

they will streamline the enforcements of public nuisances.

s enforcement was because of

minor variations.

It was somewhat hamstrung.

The blight ordinance focused on the abatement process.

These two ordinances now address that. the rest will submit.

Without social accountability or

responsible -- and has become

the most egregious violators in san francisco.

it is the right to make public comment.

It will be so egregious that it

The violator was reelected in the library commission.

it falls below the standard of decency, good faith, and right

action required of all public officials.

The violator was reelected as President Of the library commission.

Rather than being out wage -- an

outrage, it is the most flagrant public-private partnership in san francisco.

It is what the private interest gets for their money.

For the public-private

partnership, accountability has

become part of the public library' s institutional culture.

They are raising millions for the corporate elite.

You know what happens when you allow the public-private partnership with no accountability. You pretend you don' t know, but you do. the damage is a measurable.

That is why the allies need to stop. Thank you.

city, all of those things need

to be addressed with the same

attention that you give to any

municipal transportation. Thank you for your time.

As you know, I don' t often comment, but I saw something in the papers that compelled me to come here.

i did not see your first couple of hours.

But an article on that

issue in

the bay citizen quoted a staff

member of the rec and park

commission blatantly throwing

out that the board of supervisors doesn' t have any jurisdiction over the way that

they make land-use decisions.

President Chiu:   this is an item that came up here earlier.

issues, the san francisco zoo,

hank, the privatization of the

parts, this is an agency that is

out of control, totally full of

itself, and belligerent toward the board of supervisors when it comes to these issues.

We May a lost attempt to do something about that.

I think it is really time for the board of supervisors to

take

the board has the majority of those selections.

It is going to start responding . it is really crucial.

Last week I commented on pensions.

The robustness of the city retirement system.

services was on the board for decades.

i am probably one of the few cabdrivers' that will support the idea that you can' t

separate cracking down on

illegal taxis whitout -- without

addressing the need that is

creating illegal taxis.

there are some problems.

It is most likely going to

involve using spare cabs or older cars.

What I have done is offered a summary of a plan that I

introduced in 2009, a single operator taxi.

it would allow a small number of taxi drivers to buy their own vehicles and operate them as proprietors.

I would like the board of supervisors to support the resolution.

But supported with the inclusion

of single-operator taxis.

urge them to include that in

their overall peak-time solution.

I will share my plans in further detail, and thank you.

potentially been impacted by displacement caused by government activities.

our campaign has asked that the western addition be the first.

And the land use committee write

on the placement of people.

The impact -- the economic

impact, employment rates remain the same.

There is a decrease sense of the entrepreneur spirit.

The interaction with neighborhoods and the social networks, feeling that this

trust overtime helps

impact and increase rates in mobility.

There is the alienation and the result of a familiar area.

There are dozens of the voting blocs.

They are part of the same family.

I wanted to say on behalf of my community that there have been

many issues for the arab- american community.

To fight extremism or

terrorist agendas, the united states congress is having

hearings about mosques and radicalizations.

We are part of the solution to fight extremism.

review of item 34 and don' t look at us as outsiders.

We are americans, too.

We want to be part of the solution to fight extremism out there.

Every sermon that we have is simultaneously translated from arabic to english.

We have nothing to hide and you don' t have to spy on us or anything.

Feel free to visit us and you' ll see that there is no anti- american agenda.

steppingstone, the largest

provider.

it was founded in the late ' 70s

to prevent frail seniors from

going into skilled nursing

unnecessarily.

It has been a successful program for 34 years and I am now witnessing a moment where we May

lose adult day health.

This resolution before you to

oppose the elimination is very important and it is one that we

feel the board of supervisors is in a position to take a stand on.

I have a copy of the

letter, a

copy for the record and copies for the supervisors.

Does the city of san francisco

passed a living with dignity

plan that really purports the

community-based center of caring

for our frail and low-income elders?

If it is dismantled, it will put many people in skilled nursing

facilities within a month, and many more within six months.

This will have a disastrous effect for the city of san francisco.

We urge you to oppose this

measure and send this message to

our governor and our legislators at the state level.

I want to tell you a very touching story related to the health center.

We have a spanish- speaking senior who has been diagnosed

with mental delay, dimentia, and

other medical problems.

When he comes to the center, we

monitor his health condition

including medication management.

We also coordinate this medical care.

because he was sleeping in a

very comfortable hotel, one day, he disappeared. He was missing.

On sunday, they came to the

center and told us they were missing.

Our social worker filed a police report.

They found him on the street, he

was sitting on a sofa.

i immediately called a police officer and they came.

They told the police officer that he did not eat for seven days.

And that he did not take the medication.

That is what they were very concerned about.

he was put in a hospital.

Let me tell you.

When they wanted to discharge

him, they would discharge him back to the hotel.

Right now, he is sleeping in a

home.

he is still coming to our center. [Chime]

Of the 11, for are the originals

of started back in the early '

80s when san francisco helped

us make adult day health care.

We worked with other partners to bring in the community base service.

Right now, they represent 1800

people that are served annually.

If they were to be eliminated, 650 caregiver' s would have to

reduce their hours or reduced

their jobs to take care of their loved ones.

We appreciate this resolution because it is very significant when we can have meaningful

voices and numbers take the same

position. Thank you.

Dear supervisors, I am an american that has lived in this country for over 15 years.

We were second-class citizens.

I am an arab-american.

If this citizen cannot protect

I worked very closely with them on the local hiring ordnance.

i worked with for new strategies in san francisco.

There is work that she has already done.

I think it is important to recognize the work that she has done.

I was also alarmed that charlie

shamas was not put forward on the rules committee.

It has been a

strong voice for economic development and environmental justice.

With community members, building

the leadership, it is so

necessary in the city with the economic downturn that has been working hand-in-hand with

community members and has made the citizen' s committee on community development a very meaningful experience for the community to take part in.

in the past when there would be

community meetings with cccd, they would have about two minutes for public comment with the work of restructuring the

committee and having a stronger approach on community development.

They opened it up for the

community to actually take part and there to be dialogue on how

the city will be responding with its community development work.

It is not some much a cut-down

approach, it involves the community in a very interactive way.

A couple years ago, there was a

proposal that was working towards eliminating community development work in san francisco.

My office convened a working

group, working closely with him

david -- pam david to write up

the findings of the working group.

they met at 8:00 in the morning and once or twice a month to come up with a plan for how we

would be able to respond to a community problem work being done in san francisco.

We fought a new proposal where it now sits.

we have revitalization efforts, changing our approach around poverty in san francisco.

Since that time, in my district, charlie has been involved with that effort that has not existed ever in district 11.

There was a conscious discussion about how we are going to

involve members of work force development.

This is something that is new.

We are working with the citizen' s committee on community development to make this happen. It is really important to have

the continuity of charlie' s work

on the committee and I like the

motion that we add his name and

I really hate to say to take out rivera'

s name as part of the committee.

It is about the work charlie has

done and that others have done

over the years in revitalizing

the work in san francisco.

That would be my motion to swap out charlie'

s name for nicole rivera.

among other neighborhoods and a low-income neighborhoods in the city.

I will be supportive of the motion.

The board of supervisors gets to

we reflect and advance the concerns and needs of our low- income neighborhoods.

It is to strengthen the social and economic infrastructure of

the low-income neighborhoods.

We have folks that work and

represent folks in the communities.

And now as an organizer, I think he complement'

s peter cohen in being able to represent a diversity of neighborhoods.

I am very impressed with nicole

rivera, I would love to help her get appointed to another committee.

She does a lot for the city and

county of san francisco and is

qualified to serve.

The board of supervisors is trying to get representatives at work in the community, he is more appropriate for charlie.

Supervisor cohen: the issue that I specifically want to speak to

has to do with being in favor of cohen. I'

m concerned about charlie.

The reason I am concerned, one

of those things that I have heard when speaking to my

colleagues, the committee has

spoken in support of charlie , and that is wonderful.

I wanted to bring to people

close the attention -- people' s attention.

It is only a matter of time.

It is a last-minute amendment.

And having adequate time, when

they could also add equerry rally troops.

-- adequately rally troops.

I am very concerned that what happens, people they characterized for who they work

for on

a short snapshot.

they have written her off because of who she works for.

I cautioned that you use to a person' s employer is to evaluate their ability to serve san francisco.

i am also concerned that the rules committee heard the issue,

voted one way, and here we are.

I see this is a slippery slope that we will continue to fly down.

I hope we can get some kind of resolution to this particular issue.

supervisor wiener:   I am not going to be supporting this amendment.

specifically, when it comes to housing and community development, diversity is important.

Miss Rivera is involved, younger

than I am significantly.

Someone that brings that level of diversity.

It is also important to bring a fresh perspective.

across the political

spectrum,

we see people that are involved for a very long time.

It is also important to bring fresh people.

I was excited to see her name for it from the rules committee.

i know and respect her.

I can' t support this amendment.

I can' t say that this is an easy one for me.

i will be supporting the motion

my supervisor valos -- avalos,

but it is not an easy one, not

because of the individuals

involved, but because you have two pretty impressive people

that are here in the running for the seat.

the from my perspective, this is a question about what is the right fit and what is the best fit.

The think that in light of

requirements on this body, but

the experience charlie brings makes this appointment at the right appointment.

that said, I have to say that

nicole rivera is the kind of individual you want to see on a

city commission.

This is a young woman who has pretty stellar qualifications.

From my perspective, where she works is something that is positive and that adds to her credentials.

I actually see it the opposite.

I actually think this is the type of experience -- quite

frankly, in thinking about this appointment, with respect to

someone like nicole, there are prominent commissions were you want to see this kind of a talent.

there are some openings coming up. I hope and then will be in consideration for those.

I

know there was exploration for a commission on the environment. I can think of a number of

commissions where I think she

would have the expertise and

talent to serve this city well,

but I think it is unfortunate that we find ourselves in this position.

But I will be supporting the motion. Thank you.

Supervisor avalos:   just a couple

things I want to respond to.

i am not sure.

I' m not sure if charlie talked

about his ethnic background, but he is egyptian american. He has ties to turkey. I think he adds a level of diversity to the committee.

i think it is also important to note the work someone does in

the community and the process about work.

If you are someone who is part of bringing new views into the

way that the cccd does its deliberations, that is adding

new input and dialogue from

community members whose voice would not be part of that.

That is part of the mission. Charlie was part of the change in how the community has done its work. The thing that is really important to consider.

I think a good community

organizer, a good community worker -- that person' s views change as community members are involved in the process.

It is about dialogue and communication.

I do not think a good community

organizer is someone who shuns

the ideas that come from the community. I think that is the value he

brings to the cccd.

Lastly, it made it really hard

to decide whether I was going to

not select -- not vote for

nicole rivera or not.

The fact that she was a staff

member for nancy pelosi made it

difficult to want to make this amendment because of that relationship.

There is a lot of power in that relationship.

There is also a lot of access to community people from a different perspective I think is valuable.

It is based on the work turley has done in the community that has made me make this amendment.

I hope you could change your mind and support me on that effort. Thank you.

Supervisor elsbernd:   as a member of the rules committee who did not support the gentleman being put forward today but actually

supported the other candidate, maybe give me a few seconds to explain why.

People have begun to nip around the edges.

For me, the biggest concern I

have about a community development block grants is not whether enough communities are being served.

We all recognize that is a challenge and we are all trying to do that.

but I think any objective observer would recognize the biggest threat to community grant money right now is the federal government. It is the biggest problem.

The federal government is constantly making cuts.

It would seem to me if we are

trying to preserve that funding have access to that money, we would take advantage of an applicant who has the

connections that she does.

Going with my amendment here, the spreading the wealth among the communities are having

community diversity is not more important than what I think is

the biggest problem, and what any observer should see is the biggest problem, and that is the federal government.

We have the opportunity to have a great applicant.

That gentleman can help his cause and do his thing.

i think we are making a big

mistake for the future of the community development block grant by rejecting an applicant of this caliber and with this experience.

supervisor mirkarimi: colleagues, this issue is not unfamiliar to anybody here.

There has been thorough hearings on this matter. But we have learned today is

that the rec and parks

department issued an unlawful detainer against the recycling center.

I think that only escalates the

matter in what I believe is an unprincipled way.

I think this resolution is ever

more timely and signaling to all

stakeholders in this discussion.

that is to work with the hank

recycling center, dude due

diligence, and look for alternative locations.

That had not been done under

mayor newsom.

We ask that it be done.

That is what the essence of this

resolution does.

In short,

there is no plan

whatsoever to compensate for the

loss of an industrial recycling

facility that takes in

approximately 1,600 tons of

recyclables per year.

In lieu of that particular loss is a plan to have vending

machines that would be distributed in 27 areas around grocery stores.

If a think we are going to have

a people traffic problem because

people feel there is never heard this stress around the homeless, a guarantee that problem is

going to escalate exponentially when you think you are going to

put a soda machine vending

system at a grocery store where

people are simply feeding in bottles and cans to compensate for the loss of a recycling

center in a much more rapid and efficient fashion.

i think it is counterintuitive the way this has been handled by the city.

We understand they want to move on displacement.

I suggest with this resolution that they continue with good-

faith discussions in looking for alternate locations. Here is the rub.

puc wants to put a water

recycling plant on golden gate property. It is a non-conforming use according to the golden gate master plan.

Neighborhoods have spoken up and

said, "we do not want to hear it."

that are moving to look for an alternate location. On the east end of golden gate

park, there is retail like a

laundromat and others that are

also considered a non-

conforming use.

By law and by definition, they

should be affected as well.

there is an approach the city

has taken in singling out why

hank should be moved, especially

with an unlawful detainer.

That is what is represented in this resolution.

i realize some of you would like to see an amendment or tweak to this.

But I do believe that we should

move this forward, hoping that a

resolution is achieved between

all parties.

how we recycle is changing over time. This has been an important institution in our city, and certainly in the haight-ashbury neighborhood.

I do want support -- to support

the ability of this organization

to move forward and continue to provide leadership.

i hope we are able to change the

language and length that refers

to the mayor directing the termination of the lease.

Obviously, we are still right

now before the

city, alternative

recycling services

, a to negotiate in good faith the

determination of henk' s lease.

i wish the unlawful detainer had not moved forward.

I do hope that despite what is happening that they will be able to work on a path that will

allow henk to continue.

Rec and park have acted in good faith. I do not want to set a standard that having a number of hearings is not good faith.

making this amendment sets that President. I think that would be a serious mistake. If you have a problem with what

they have done, but for the resolution. But do not set a legal

precedent that having a number

of public hearings is not acting in good faith. That is a serious mistake.

This has a lot of serious

repercussions beyond henk.

But this amendment is much

bigger and potentially sets a precedent I do not think the maker has thought through.

I would urge a no vote.

appreciate the warning side, -- sign, but that is the corpus of

why we had a hearing at the board of supervisors, because of

what was omitted and absent in

commission hearings about henk,

and the question

of how that justifies displacement based on

the city master plan, the lack

of recycling and what to do with a particular turf of the park.

Not a lot of this detail came

out in new -- in the rec and park hearing.

We were well informed by dissecting very clearly what was discussed and not discussed.

Clearly, it was already a presupposed determination to move on hanc.

That is what the band was. The fact is that there were plenty of details that came out

in this particular board of

supervisors.

Rec and park is one of only two commissions citywide that are not appealable to the board of supervisors. frankly, sometimes, when the are

not in agreement with us

, I am sure soon that is going to come back as well.

As it relates to this particular

notion, that is why the hearing was so substantive is because of

the fact that if anyone

believes you are going to lose a recycling center with that capacity and think you are going

to replace it with a vending machines in the surrounding

area, you have 10 times more

reason to have a sit-lie law that is not going to be implemented.

Supervisor campos:   I simply want to say that I think it is very

unfortunate that we did have this unlawful detainer action

being filed.

I think it is very unfortunate we got to this point.

I am very hopeful that the city reconsiders the action.

I know they -- I know there are very passionate perspectives on this.

I would respectfully ask the mayor' s office to step back and rethink the way this issue is being approached.

The fact is that some of the

decisions that have been made predate this administration.

I think the fresh perspective of the mayor' s office has taken on a number of issues is one that is badly needed on this one.

i would hope there is reconsideration of where we are on this issue.

With respect to the rec and park

commission, I understand the reasons people are moving in this direction, but I respectfully believe this action

is misguided, and I do disagree

with the outcome so far.

I would hope that the department reconsidered. Thank you.

campos, I am not saying you cannot disagree with what they did or have a different opinion about the outcome.

I think this amendment potentially has more

ramifications beyond this issue, the notion that the process they have done is a process that can never follow again.

representative peter king from rhode island appears to harbour

fears and happiness of the muslim community of the united states. Of the homeland security

committee, on thursday, he plans to open the first of a series of hearings into the threat of

home-grown islamic terrorism and the allegation that muslim americans have failed to cooperate with law enforcement efforts to foil terrorist plots. I felt there should be at least

some response to what I think is

a very severe action by this

particular congressman .

This resolution speaks to that.
