for years to take a step to extend our transit impact fee

that will be known as is

sustainability fee to

residential construction the sustainability fee was adopted

35 years ago and for all those decades applied to commercial

development but not to residential

and so residential development

in san francisco moornlt how

large does not autumn pay the

transit development fees a hole

in the fees of this growth if

inform san francisco it is

critically important our transportation infrastructure

keep up with our housing approximate and transit impact

fees are one way to do that colleagues you'll recall 3 years

ago when the renewal of the impact fees we had discussions about that fee and moving

forward we have now the opportunities to take this huge

step and to extend the fee to

residential development it will generate hundreds of million dollars of duo dollars for the

transportation improvement over

the next 15 years in combination

with the prop b from the ballot

that ties transit that funding

to population growth and the prop a the transportation bond

as well as upcoming

opportunities with the vehicle license fee we're gaining

monument in san francisco to

funds the modern and reliable

transit system we all need over transit systems are over

capacity and necessarily we need

to extend that for that bart and all the systems

of course, we in committee had a lot of discussion about what the appropriate level of the fee was

we in committee did increase the

fee by one dollar per square feet for residential and

commercial for large projects we

also removed the plan areas

exemption and then we also

limited the grandfathering

provision to end as of July 21st

the date of introduction of this legislation

so this has been a thoroughly thor vetted piece of legislation

0 takes a huge step forward to

get the knocks to the

residential we did a lot of work in committee to extend it

further I know there is discussion about other aspects

of the legislation with one can

take the position the fee should

be higher than self-is no matter

would level someone will step

forward and say it is should be

higher but right now this

legislation takes a big step forward and appropriately

balances the need for our

transit fund and for transit

impact fees with making sure

that we are actually having housing built in san francisco

so colleagues, I ask for your

support and we want to thank

everyone in making this legislation a reality.

someone so I will be proposing making some amendments I believe that the planning department and

the mta did really great work on crafting our transit standpoint

program and the fee is something

we spell need as as city all of the colleagues have been voting

11 zero to put anymore funds into transportation needs in san francisco we are dedicated to

doing that I have been glad we

all that had consensus we need

to fight for all dollars for transportation in san francisco

we've talked about also trying

to find every dollar whether we

can find for the infrastructure in the city we actually have a

lot of money left on the table

with the transit sustainability fee I sat in at the land use

commission I felt that was important we bring this effort

into the light of day into the

legislative arena the discussion that had been done before coming

to committee was in the mayor's

office setting what what the fee

will be developers or creating a

deal one of the on that was

going on and we look at what the

fee is compared to what the nexus study will measure the

impacts and what we're chair mar

for the fee will be pay for the residential impacts and

non-residential

we are also not taking into consideration that projects had

that have been in the pipeline

before July 1st of last year

2014 anticipating that that fee

would be established yet giving

them a pass for the for the most

part and not doing it but

collecting has much as we can. Many of the developers that are impacted saw it coming

and so I'll be proposing we actually have grandfathering

with a fee only residential and non-residential I've been concerned I actually went to the planning commission

with when the planning

commission was reviewing the tsf

to look at how different fees levels for different parties

part of san francisco we see

development happening at the

gangbusters levels other plays in san francisco not seeing that

happen particularly in district

11 we looking at a one-size-fits-all fee for the

entire city does that create a disincentive for development in places where land values are not

quite as high as in the downtown

core the city I'll be proposing

that we look at having a

geographic study about to set

the structure for the fee based

on geography in california I'd

like to propose a number of

those amendments if you May

indulge me colleagues, I have a

handout you'll receive the first

is the motion to increase the

non-residential fee for gross

square feet of 8 hundred to 99

thousands to 18 and $0.54 a

number of months ago that will

be together we'll want to take them spacial and commissioner

avalos have you handed out those amendment. >> I have it explains what the

amendments and the city attorney

has crafted legislation that has

actual language prepared for not

necessarily for your desk but at

the end of the day it will be

made in accepted.

square feet to raise the fee

$0.50 to $8.54

also on non-residential to over nine hundred and 94 thousand 99

gross square feet to raise it $4

to $23.04 that's below the

nucleus 23 percent nexus so we'll be addressing the impacts

on transportation but it will be

only a small portion that is my first. >> you want to take both of

these together. >> yes. >> okay. So commissioner

avalos has made a motion seconded by supervisor campos

and Madam Clerk is there any

discussion regarding the amendment. >> seeing no- >> supervisor campos. >> thank you. I do want to say something not only about that specific amendment but actually

think that applies to the variance amendments we know that

will be presented and I think to members of the public that are

watching this I think that if

there's every an example of power that those corporate and

players have in this building in

many respect about to happen is

an ill nexus study is the length of development and

transportation and it shows that

when you build like this city

has been building there's a cost

associated with that and that

cost has prelims in the transit system it is interesting people

talk about how much they support public transit and promote

public transportation when it

comes to forcing powerful

commentary interests and money

interests to pay for this that

is where somehow the commitment

goes away or you know weathers down a little bit because what commissioner avalos is talking

about here is actually a modest

increase that talks about

essentially on this charging 21

percent in the case of the first amendment and 21.2 percent is

permissible under the nexus

study and the ceqa second

amendment in his motion on

charges 23.8 percent of the

nukes what it shows we can charge we're talking about

hearsay of billions of left on

the table if there is ever an example of a corporate give away by the city and county of san

francisco this is it

and so when we have discussions we will going forward in 6

months or a year if now how we

need more money for

transportation let's not forget

what people are doing today

giving in m many rights a pass

to folks that should be asked to

pay their fair share and are not being asked to pay their fair

share when we come out here and

say how we need to find more money for transportation let's remember that we left a lot of

money on the table here today and even that at the end of the

day it is not what we say about

public transit but willing to do

to make people pay for that that

I want to better understand what

this does in terms of

feasibility a month somebody calculated and how conservative it the palm that was circulated.

working the numbers I'll say in

some parts of city we were at

the max in terms of the feasibility study we were

comfortable with it is

discussions but the tilt feasible analysis we were

middle-income in certain areas

I'll let any staff answer that if I could.

ram men's we reran the feasibility numbers taking into consideration the childcare fee

in the areas where the growth is

anticipated in the area plan

where about 60 percent of growth

anticipated for 4 out of the 6 protocols the new mooementd amended fee because the

childcare fee is with the

feasibility but for chronicling

the portfolios we were using a

general indicator further we

found in some of the areas that

are currently not feasible the fee could you know continue to

impact the feasibility but we

did find overall for projects

where an areas that are

generally feasible into fees

will not impact that legislation. >> okay. >> supervisor mar.

>> I said to thank Ms. Chin

and director ram for explaining that I'm supportive of

supervisor campos amendment I

think that looking at the the

several the feasible study and

the nexus study that the maximum

amaze we could bump it up sixth

higher and be well within the

maximum amount I think that

supervisors developments are

reasonable they're actually very

modest combaus because

supervisor campos mentioned

$0.50 more for the so-called

smaller and roughly one homicide

thought square feet not near the

maximum of the feasibility study part of the nexus study I'm

supportive and appreciative it

is graduated or teetered so it really take into consideration

the the impacts from the much larger developments I'm

prevalent supervisor campos is

right that this the studies

allow our city to allocate much

more I think what was proposed

by commissioner avalos is modest

given what the study shows

thanks to supervisor wiener and the mayor's office I'm supportive of increasing the

fees as property by commissioner avalos.

you know, I wasn't going to say anything no response to

commissioner avalos amendments I

respect his right I've said at

the beginning from someone

supervisor or anyone can always

want one can say it should be a

bit higher and we have increased

residential transit impact fees

in the legislation if zero to almost $8 per square feet i

think that is important to see

where we've started if zero to

$8 per square feet and this is a huge step forward

so and despite some of the raefr

dramatic rhetoric we've heard in

chambers are in today, if you

don't support whatever the

highest number someone proposes

your somehow not really fighting

for transit funding that is

frankly on absurd agreement some

of us fighting for transit

funding hard for years work hard

to get prop b for example,

passed last November which half

of the board voted against to get the mooning bond passed and

working to make sure we go to

the ballot next November with

the vehicle license fee this

legislation in its current form I provide significantly increased transit funding

there are a lot of people in the

development community who are

unhappy we introduced

legislation to begin with that extended the impact fees to the

residential development and

people upcoming u unhappy people

in committee supervisor cowen

and I were they were unhappy

with us to support the changes

we're trying to engage in responsible law making we

actually do work over a period

of years instead of dive bombing

at the last minute and come up with responsible legislation that take into account the views of stakeholders and moving forward with legislation that will significantly increase funding for our transit system

and do so in a responsible way

responsibility policymaking

store that some people find it difficult to make developers uncomfortable but the reality is

that the level of development

that is happening in this city

is not only impacting the

housing because the buildings

that has focused on luxurious housing but impacting transportation as well

so before we get this on this

high horse of how we always done

with what we are supposed to in

transportation funds to some step up to the plate we have

except when it impacts our

friends in the development what we say at the end of the day is

what matters we'll see that today. >> commissioner avalos. >> just to call the vote on

of amendments so my name is on

submitted before jill first 2014

would pay 50 percent, between

the difference between the tdif

between July 2015 pay 50 percent

between the tsf and tdif

projects after that pay the full

tsf

tem we had a lengthy discussions of grandfather provisions in

committee there was always when

you change the rules on anything

in particular about costs and fees that are associated with

some things that is always a

little bit tricky when you make that retroactive we know that depending on the size of the

project those fees what about

quite large which is frankly a

good thing and when projects try

to pencil out for the financing

and so forth they assume certain

things the tsf is a discussion on and off a a long time given the history of that board and

should some of the votes in 2012

none can take anything for grant out of the legislative process and the amendments in committee

that increased the fee and the

attempts to increase the fee

today is reasonable not to

assume everyone knew that was going to happen the grandfathering does not wave the selfie but reduces the fee for

promotions in the pipeline and

for older projects they don't

say have to pay is that make sense before this legislation was drafted

when I authored the water

recycling legislation earlier

this year to require water recycle in large new developments we made a prospective for projects that

are that going to be entitled after a certain period of time we thought that was important because again those promotions

when you're putting it together

and determining what you'll pay

for affordable housing or impact fees you make south american

assumption on the lay of the

lands and changing the rules you

have to be very, very careful

that strikes a balance didn't need to be amend. >> thank you, supervisor kim on the amendment. >> thank you. I just wanted

to share my comments inform

support of to amendment I

actually think there has been incredible public knowledge

about our plans to raise the transit impact fees

this was actually heard at the board of supervisors over two

years ago and so I think many

developers and projects were

aware we remember considering

the increase I think we should be imposing a percentage the fees on projects

in the pipeline as an example we

had one project that was

submitted before July 1st of

2015 and I've negotiated with

the project in the south of

market that they will be pca paying a portion of

transportation fee I felt that was important for residential

projects to be paying those fees

it is something that is feasible for the developers regardless how this move forward but be consistent amongst the

development but in particular if

you submitted our proposal after July 21st after the introduction

of this ordinance I think you should absolutely be paying 100

percent of the transit fees

I think that you know overwhelmingly increasing

particularly in the districts I represent I'm hearing more and more if neighbors if others districts the congestion is

becoming unbearable and we need

to make sure that we are

catching with existing needs to

make sure we are approving public transit and improving the

traffic flow on the roads there

is a direct co-relation between

the new residential development with the congestion we've

experiencing in the city I'll be supporting this amendment. >> thank you, supervisor kim

tsf applies to any projects submitted after July 21st the

introduction date of this year

an agreement with the nonprofit hospitals that will be

contributing to the transportation system the

hospitals were 100 percent

exempt of paying the fee on medical facilities and today

colleagues, I have plans I want your support asking you to duplicate that ordinance and

amend the hospital provisions to

include the following

a $18 fee on new hospital beds

effective immediately not after

the sxoo schematic mandate, a

new $11 fee on medical services

over 12 thousand square feet and

additional signages on

conforming changes

I want to also take a moment and

recognize the flexibility of

director ram and director ed

reiskin and my staff have afford

myself and my staff and the hospital association david in

particular it's been under a particular amount of stress to wrestling the members and

bringing them to the table glad for his willingness to work with us

I think that is important to acknowledge by calculating the hospitalization fee by the net

new beds we're acknowledging

that hospitals that have not yet

under gotten the schematic

upgrades are increasing their

square footage to meet state

guidelines for new equipment,

technology, and hospital rooms but not necessarily increasing the number of beds

I know that is a mouthful an

important point it is important

to note that new agreement

impose a fee on which will have

otherwise been exempt medical

services like large clinics and

outpatient stability over a 12 thousand square feet

and we know from talking about

with the household we know the

expansion of medical services is

actually the direction that many

of them are pursuing rather than

increasing the number of

hospital beds so both new

hospital beds and medical office and service buildings have

transportation impacts in our

neighborhoods and it is

essential and fair they

contribute something to our transportation system

so for example, when we are

dealing with camtc has several

impacts with the 49 admission

and geary and 19 polk mitigate

by the payment to the project

without the candidates the city wouldn't have been able to pick

up the costs of improvements

those funds benefit our city transit riders but especially

the patient and the employees of

hospital that often heal I

didn't rely on the health care services because this agreement

establishes a new fee is requires an additional committee meeting we've discussions earlier

and in an effort not to hold up

9 whole tsf ordinance I ask we

cup the file and amend the duplicated file as I've previously described in which

the clerk has circulated to you again, this is evaluating the

fees to $18.74 with the beds and

establishing an $11 feces fee

for over 12 thousand feet and the size and scale of the

medical serves as part of motion

I want to also refer the amended

duplicated file back to the land

use and transportation committee for an additional hearing.

then in 1980 growing by one hundred thousand people over the

last decade and continue to grow

by 10 thousand people per year san francisco will steady one

million people in the bay area

will grow by over 2 million

people our streets are more and

more congested that has all sorts of impacts including the impacts on the transportation

system we need to move more of

our transit systems underground

and to avoid the congestion

entirely bart's system as well as the market street subway

opened in the late 1970s fast

forward we've not opened one additional inch of subway

capacity even as our city grows

by 200 though people muni has

the lowest transportation aid we

have to be aggressive moving

more transit underground opening

the central subway in a few

years that's terrific and not

make the mistake by allowing

everything to grind to a

hallucinate e halt once we on the central subway we need

subways under construction and

planning and keep that monument moving forward

and so this legislation will enable

us to have a sounding board a

long term plan to make sure we

keep our subway moving forward

halls more drinking waters the

puc and the school district have

been selling scores of hydration

and encouraged to drink water
